How to read a Montenegrin list nepokretnosti

The property sheet has five sections, and two of them decide whether a purchase is safe. Here is what each one answers, in the order a buyer should read them.

A Montenegrin property sheet — list nepokretnosti, LN for short — is the register's answer to one question: who holds what rights over this property, and what limits those rights. It is two pages of tables with no summary and no commentary, which is why a buyer can read the whole thing and still miss the one line that matters.

Every LN belongs to a cadastral municipality (katastarska opština, KO). The number alone is not an address: LN 1782 exists in dozens of KOs and means a different property in each. A reference is only complete as KO plus LN.

PREPIS or IZVOD — check which document you were sent

Before reading anything, read the header. The register issues the sheet in two forms and prints which one you have straight after the sheet number: PREPIS is the full transcript, IZVOD is an extract, and an extract can legitimately omit the sections a buyer most needs. Ask for the transcript.

Read them in that order once, to understand the property. Then read the last two again, because that is where a purchase goes wrong.

Encumbrances: the section that is never blank by accident

Podaci o teretima i ograničenjima lists what burdens the property. A mortgage is the entry buyers expect; the ones that surprise them are usufruct (plodouživanje), a right of use that can outlive the sale, and usurpation (uzurpacija), which says someone has occupied land they do not hold rights to.

When there is nothing to report the register says so explicitly — a line to the effect that no encumbrances or limitations exist. An empty section with no such line is not the same thing, and is worth a question rather than an assumption.

Pending applications: the trap that a clean encumbrance section hides

Podaci o aktivnim zahtjevima lists applications that have been filed and not yet decided. This is the section buyers skip, and it is governed by a rule about timing: under Article 12 of the cadastre law, registration follows the order in which applications are filed, and a registration takes effect against third parties from the moment the application reached the authority.

So an application filed last month and decided next month outranks a purchase completed today, and an encumbrance section showing nothing alarming is not sufficient on its own. Why is the LN number not enough to identify a property?

Because the number is only unique inside one cadastral municipality (katastarska opština). The same LN number exists in many KOs and denotes a different property in each, so a reference needs both the KO and the LN.

Does the property sheet name the owner in full?

It names the holder of the right, but this view of the register does not publish a national ID number or address. Confirming that the person signing is the person on the sheet is the notary's job, not the document's.
